By downloading, installing, accessing, or using Somoni, you agree to these Terms. If you do not agree, do not use the App.
For an App obtained through Apple’s App Store, the licence to use the App is governed by Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), which is incorporated here by reference. These Terms govern Somoni’s informational features and supplement, but do not replace or conflict with, the Apple Standard EULA. If there is a conflict about the licence, the Apple Standard EULA controls.
The agreement is between you and Shokhrukh Akhmatov, not Apple. The Developer, not Apple, is responsible for the App, its content, maintenance, support, and claims relating to it. Apple has no obligation to provide maintenance or support and is a third-party beneficiary entitled to enforce the applicable licence terms.
Somoni is a comparison and calculation tool. It is not a bank, financial institution, money transmitter, exchange, broker, payment provider, investment adviser, accountant, or legal adviser. It does not execute transfers, hold money, open accounts, approve cards, set exchange rates, or guarantee that a transaction will occur.
Rates, fees, limits, partner offers, and availability can change at any time. Data may be delayed, incomplete, rounded, incorrectly entered, unavailable, or different from a provider’s final quote. Calculations are estimates. Always confirm the final rate, fee, recipient amount, eligibility, identity requirements, and terms directly with the bank or transfer provider before acting.
Rate alerts and reminders are convenience features and may be delayed, duplicated, or not delivered because of network conditions, device settings, operating-system restrictions, stale data, or service interruption. A notification does not reserve or guarantee a rate.
Somoni may display paid ads through Google AdMob and Yandex Mobile Ads and may show partner offers or referral links. Advertising, ranking, or a link does not constitute financial advice, endorsement, warranty, or a guarantee of suitability. A partner relationship or referral compensation does not make Somoni a party to your transaction.
Third-party websites, apps, banks, ad networks, and transfer services have their own terms, privacy practices, eligibility rules, and responsibilities. Review them before use. Somoni does not control or accept responsibility for their content, security, availability, decisions, or performance, except where applicable law does not permit exclusion.
You are responsible for checking information, complying with applicable laws, using authorized services, protecting your device, and deciding whether a service is suitable. You must not misuse the App, interfere with its operation, attempt unauthorized access, automate abusive requests, scrape or resell data without permission, introduce malicious code, misrepresent affiliation, or use the App unlawfully.
The App, design, software, and original content are owned by the Developer or licensors. Bank, service, Google, Yandex, Apple, and other third-party names and marks belong to their owners. Display of a mark identifies a source or offer and does not imply sponsorship. Rights granted to you are limited to those in the applicable Apple Standard EULA, app-store rules, open-source licences, and mandatory law.
We may correct, update, remove, suspend, or discontinue features, rates, offers, advertising, or the App. We do not promise uninterrupted or error-free availability. We may update these Terms prospectively; continued use after the effective date means acceptance where permitted by law.
To the fullest extent permitted by law, the App and information are provided “as is” and “as available,” without express or implied warranties, including accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes consumer guarantees or liability that cannot lawfully be excluded.
To the fullest extent permitted by law, the Developer is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss; lost profit, opportunity, data, or goodwill; or losses resulting from reliance on rates, calculations, alerts, ads, partner offers, third-party services, outages, or unauthorized device access. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and are not listed on a U.S. Government prohibited or restricted-party list. You must comply with applicable third-party terms, including wireless-data and app-store terms.
You may stop using the App at any time. Your licence may terminate if you materially violate applicable terms. If a provision is unenforceable, it will be limited to the minimum necessary and the remaining provisions continue.
These Terms are governed by the laws of the Republic of Tajikistan, without regard to conflict-of-law principles, except where mandatory consumer law in your place of residence applies. The Apple Standard EULA may specify additional governing-law rules for the licence.
